Terms of Service

Important: Please read these Terms carefully before using Findivo. By creating an account or using our platform, you agree to be legally bound by these Terms. If you do not agree, you must not use Findivo.

1. About Findivo

Findivo ("we", "us", "our", "the Platform") is an online classifieds platform operated by Findivo Technologies, providing services at findivo.ie. Findivo enables landlords, estate agents, tenants, and buyers to publish and discover property listings, vehicle listings, submit rental/purchase applications, exchange documents, and communicate through our integrated messaging system. Findivo Technologies is not a licensed estate agent, mortgage broker, financial adviser, or legal adviser. We are a technology intermediary only. All transactions, agreements, and contracts entered into between users are solely between those users and do not involve Findivo Technologies in any legal capacity. We reserve the right to update, modify, or discontinue any part of the Platform at any time without prior notice.

2. Eligibility & Account Registration

2.1 Age Requirement. You must be at least 18 years of age to create an account or use Findivo. By registering, you represent and warrant that you are 18 years of age or older. If we discover that a user is under 18, we will immediately suspend and delete their account without notice. 2.2 Accurate Information. You agree to provide accurate, current, and complete information during registration and to update such information promptly if it changes. You must not impersonate any person or entity or misrepresent your identity, professional credentials, or affiliation. 2.3 Account Security. You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at support@findivo.ie if you suspect any unauthorised access to your account. Findivo Technologies accepts no liability for any loss or damage arising from your failure to maintain the security of your account. 2.4 One Account Per Person. You may register only one account per individual or legal entity. Duplicate or fraudulent accounts will be permanently banned. 2.5 PSRA Licence Verification. Estate agents are required to submit their PSRA (Property Services Regulatory Authority) licence number and supporting documentation. By submitting such information, you confirm it is authentic. Providing false PSRA credentials constitutes fraud and we reserve the right to report such conduct to the relevant authorities.

3. Permitted Use & Prohibited Conduct

3.1 Permitted Use. You may use Findivo to list genuine property or vehicle listings, submit genuine applications for properties or vehicles, upload documents required for tenancy or purchase applications, communicate with other users in connection with a listing, and manage your account and preferences. 3.2 Prohibited Conduct. You must not: (a) post false, misleading, or fraudulent listings; (b) list properties or vehicles you do not own or are not authorised to list; (c) demand or solicit payments outside the Platform in exchange for prioritising applications; (d) harass, threaten, defame, or discriminate against any user on the basis of race, gender, religion, nationality, disability, sexual orientation, or any other protected characteristic; (e) use automated bots, scrapers, or scripts to access, extract, or copy any content from the Platform; (f) attempt to gain unauthorised access to any part of the Platform, its servers, or any connected systems; (g) upload viruses, malware, or any malicious code; (h) share, re-sell, or commercially exploit any data obtained from the Platform without our express written consent; (i) use the messaging system to send spam, unsolicited commercial communications, or phishing content; (j) circumvent or attempt to circumvent any security measures, access controls, or rate limits implemented by Findivo; (k) misrepresent your identity, qualifications, or the condition of any property or vehicle listed. Violation of any of the above may result in immediate account suspension, permanent ban, and/or referral to An Garda Síochána or other relevant authorities.

4. Listings

4.1 Accuracy. You are solely responsible for the accuracy, completeness, and legality of your listings. Findivo Technologies does not verify the accuracy of listing content beyond PSRA licence verification for estate agents. 4.2 Content Standards. All listing titles, descriptions, photographs, and videos must accurately represent the property or vehicle being listed. Photographs must not be digitally altered in a manner that misrepresents the property's condition. 4.3 Removal. We reserve the right to remove any listing at our sole discretion that we believe violates these Terms, applicable law, or that has received credible complaints. We will endeavour to notify you of such removal but are not obligated to do so. 4.4 No Guarantee. Findivo does not guarantee that any listing will receive enquiries, applications, or result in a successful transaction. We make no representation as to the fitness, legality, or habitability of any listed property. 4.5 Title Limit. Listing titles are limited to 60 characters and descriptions to 1,800 characters to ensure quality and clarity. 4.6 BER Certificate. Where applicable under Irish law, landlords and sellers are required to hold a valid BER (Building Energy Rating) certificate. It is your legal obligation to provide accurate BER information. Findivo accepts no liability for failure to comply with BER certificate requirements.

5. Applications & Documents

5.1 Application Submissions. When a user submits an application for a property or vehicle, they consent to sharing their profile information, uploaded documents, and application details with the listing owner. 5.2 Document Upload. Users may upload personal and financial documents (including but not limited to: employment letters, payslips, bank statements, PPS number documents, IRP cards, work permits, visas, and passport stamps) for the purpose of supporting their rental or purchase applications. 5.3 Document Access. Uploaded documents are accessible only to: (i) the uploading user; (ii) the listing owner to whom an application has been submitted; and (iii) Findivo Technologies administrative staff where necessary to investigate a complaint, enforce these Terms, or comply with a legal obligation. 5.4 Document Retention. Documents are stored for the duration of your account's existence. Upon account deletion, all associated documents will be permanently deleted within 30 days, except where we are required by law to retain them. 5.5 No Endorsement. Findivo does not verify the authenticity of uploaded documents and does not endorse any applicant or their suitability for any property or vehicle. 5.6 Auto-Rejection. Applications not responded to by a listing owner within 48 hours may be automatically processed. Listing owners are responsible for reviewing applications in a timely manner.

6. Messaging System

6.1 Purpose. The in-platform messaging system is provided solely to facilitate communication between applicants and listing owners in connection with a specific listing or application. It must not be used for any purpose unrelated to a legitimate listing or application. 6.2 Monitoring. You expressly acknowledge and consent that Findivo Technologies and its authorised administrators may access, review, and retain messages exchanged through the Platform's messaging system where: (a) a complaint of harassment, fraud, illegal conduct, or Terms violation has been made; (b) we are required to do so by law, court order, or regulatory directive; (c) we have reasonable grounds to believe a message contains evidence of criminal activity; (d) we are investigating a support ticket or dispute. 6.3 No Privacy Expectation. You have no reasonable expectation of privacy in messages sent through our platform. Findivo Technologies is not a communications service provider and does not offer end-to-end encryption. 6.4 Content Responsibility. You are solely responsible for the content of your messages. Sending threatening, abusive, discriminatory, fraudulent, or sexually explicit messages is strictly prohibited and may result in immediate account termination and referral to law enforcement.

7. Intellectual Property

7.1 Platform Content. All content on the Findivo platform, including but not limited to software, design, logos, trademarks, and written content created by Findivo Technologies, is the exclusive intellectual property of Findivo Technologies and is protected under Irish and international copyright law. 7.2 User Content. By uploading or submitting any content to Findivo (including listing photos, descriptions, and messages), you grant Findivo Technologies a non-exclusive, royalty-free, worldwide, perpetual licence to use, store, display, and reproduce such content for the purpose of operating and promoting the Platform. You represent that you hold all necessary rights to grant this licence. 7.3 Restrictions. You may not reproduce, distribute, modify, create derivative works from, or exploit any part of the Platform or its content without our prior written consent.

8. Privacy & Data Protection

8.1 GDPR Compliance. Findivo Technologies is committed to processing personal data in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679, the UK GDPR, and the Irish Data Protection Act 2018. Full details are set out in our Privacy Policy. 8.2 Data Storage. All user data, including personal information, documents, and messages, is stored on Microsoft Azure servers located in the United Kingdom. Azure is a certified data processor compliant with GDPR and ISO/IEC 27001 security standards. 8.3 Data You Provide. We collect and process the following categories of data: registration information (name, email, phone, role), listing content, application data, uploaded documents, messages, and technical data (IP address, device type, access logs). 8.4 Legal Basis. We process your data on the following legal bases: (i) contract performance (to provide the Services); (ii) legitimate interests (platform security, fraud prevention); (iii) legal obligation (compliance with applicable law); and (iv) your explicit consent where required. 8.5 Your Rights. Under GDPR you have the right to: access your data, rectify inaccurate data, request erasure ("right to be forgotten"), restrict processing, data portability, and to object to processing. To exercise any of these rights, contact us at privacy@findivo.ie. 8.6 Data Retention. We retain your personal data for as long as your account is active, plus a period of 6 years thereafter to comply with Irish statutory limitation periods, unless a longer retention period is required by law.

9. Security & Limitation of Liability for Data Breaches

9.1 Security Measures. Findivo Technologies implements industry-standard technical and organisational security measures to protect your personal data, including but not limited to: password hashing using Argon2 algorithm, HTTPS/TLS encryption in transit, access controls and role-based permissions, infrastructure hosted on ISO 27001-certified Microsoft Azure, and regular security monitoring. 9.2 No Absolute Guarantee. Notwithstanding the security measures described above, no method of electronic transmission or storage is 100% secure. Findivo Technologies cannot and does not guarantee absolute security of your data against all possible threats, including sophisticated cyberattacks, zero-day vulnerabilities, or other events outside our reasonable control. 9.3 Limitation of Liability for Breaches. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Findivo Technologies shall not be liable for any loss, damage, or harm arising from: (a) unauthorised access to our systems by third parties (hacking) despite reasonable security measures being in place; (b) data breaches caused by vulnerabilities in third-party software or infrastructure providers; (c) force majeure events including but not limited to cyberattacks, natural disasters, or acts of government. 9.4 Breach Notification. In the event of a personal data breach that is likely to result in a high risk to your rights and freedoms, we will notify you without undue delay in accordance with our obligations under GDPR Article 34. We will also notify the Data Protection Commission (Ireland) within 72 hours as required by GDPR Article 33. 9.5 Your Responsibility. You are responsible for maintaining the security of your own account credentials. Findivo Technologies accepts no liability for breaches arising from your own negligence, including use of weak passwords, sharing of credentials, or failure to report suspicious activity.

10. Fees & Payments

10.1 Currently Free. During our launch period, all core features of Findivo — including listing publication and application submission — are provided free of charge. We reserve the right to introduce paid features, subscription plans, or listing fees in the future, and will provide at least 30 days' notice before doing so. 10.2 No Financial Transactions. Findivo Technologies does not process, hold, or transfer any rental deposits, purchase payments, or other financial transactions between users. Any financial arrangements between users are entirely outside the scope of the Platform and Findivo accepts no liability in relation to such arrangements.

11. Disclaimers & Limitation of Liability

11.1 "As Is" Basis. THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. 11.2 No Liability for User Content. Findivo Technologies is not responsible for the accuracy, completeness, or legality of any user-generated content, including listings, documents, or messages. 11.3 No Liability for Transactions. Findivo Technologies is not a party to any agreement, rental contract, or sale agreement between users. We accept no liability for any dispute arising from such arrangements, including but not limited to: failure to pay rent, deposit disputes, misrepresentation of property condition, or non-completion of a sale. 11.4 Aggregate Liability Cap. TO THE MAXIMUM EXTENT PERMITTED BY LAW, our total aggregate liability to you for all claims arising under or in connection with these Terms shall not exceed €100 (one hundred Euro). 11.5 Consequential Loss. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity. 11.6 Jurisdiction Specific Rights. Nothing in these Terms limits or excludes any liability which cannot be excluded under Irish consumer protection law, including the Consumer Rights Act 2022 or the Sale of Goods and Supply of Services Act 1980.

12. Indemnification

You agree to indemnify, defend, and hold harmless Findivo Technologies, its directors, officers, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) content you submit, post, or transmit through the Platform; or (e) any claim by a third party resulting from your conduct on the Platform.

13. Termination

13.1 By You. You may delete your account at any time through the Platform settings. Upon deletion, your personal data will be removed in accordance with our data retention policy (Section 8.6). 13.2 By Us. We reserve the right to suspend or permanently terminate your account at any time, with or without notice, if we determine in our sole discretion that: (a) you have violated these Terms; (b) your conduct poses a legal, reputational, or security risk to the Platform or its users; (c) you have provided false information during registration; or (d) we are required to do so by law. 13.3 Effect of Termination. Upon termination, your right to access and use the Platform immediately ceases. Sections 7, 8, 9, 11, 12, and 14 of these Terms shall survive termination.

14. Non-Discrimination & Equal Opportunity Policy

14.1 Prohibition on Discriminatory Listings. All listings published on Findivo must comply with the Equal Status Acts 2000–2018, the Prohibition of Incitement to Hatred Act 1989, and all applicable Irish and EU equality legislation. You must not publish any listing that discriminates against, excludes, or makes any indication of preference based on: (a) gender, civil status, or family status; (b) age; (c) disability; (d) sexual orientation; (e) race, colour, nationality, or ethnic or national origin; (f) religion or membership of the Traveller community; (g) housing assistance recipient status (including HAP, RAS, or other State housing supports). 14.2 Prohibited Language. Listings must not contain language, images, or descriptions that directly or indirectly indicate a preference for or against any person based on the characteristics listed above. This includes statements such as "no HAP," "no children," "professionals only," or similar expressions that may constitute unlawful discrimination. 14.3 Enforcement. Where a discriminatory advertisement is identified: (a) The listing will be removed immediately and without refund; (b) The matter may be referred to the Irish Human Rights and Equality Commission (IHREC) and/or the Workplace Relations Commission (WRC); (c) Repeated violations may result in permanent account termination and referral to An Garda Síochána. 14.4 Reporting. If you believe a listing contains discriminatory content, please report it immediately to legal@findivo.ie with the listing URL and details of the concern.

15. Content Standards

All content submitted to Findivo — including listing titles, descriptions, photographs, and videos — must meet the following standards: (a) Accuracy: Content must accurately represent the property or vehicle being listed. Photographs must not be digitally altered to misrepresent the property's condition, size, or location. (b) Relevance: Listings must relate only to the actual property or vehicle being advertised. Cross-listing (publishing multiple listings for the same property) is prohibited. (c) Language: Content must be in English. Content must not contain profanity, sexually explicit material, threats, hate speech, or any content that is unlawful under Irish or EU law. (d) Contact Information: Listing descriptions must not contain personal contact details, email addresses, or URLs directing users away from the Platform for the purpose of circumventing our services. (e) Accuracy of Price: The listed price must be the actual asking price. Hidden fees, conditional pricing, or misleading price representations are prohibited. (f) BER Certificates: Where required by Irish law (Residential Tenancies Act / Building Energy Rating regulations), listings must include accurate BER rating information. Providing false BER information may constitute a criminal offence. We reserve the right to edit or remove any content that does not meet these standards, at our sole discretion, without notice or liability.

16. Complaints & Reporting

16.1 Reporting a Listing. If you believe any listing on Findivo violates these Terms, contains discriminatory content, is fraudulent, or is otherwise unlawful, you may report it by: (a) Emailing legal@findivo.ie with the subject line "Listing Report" and including the listing URL and details of your concern; or (b) Contacting our support team via the support ticket system in your dashboard. 16.2 Response Times. We aim to acknowledge all reports within 48 hours and to take appropriate action within 5 business days. Complex matters may take longer and we will keep you informed of progress. 16.3 User Complaints Against Us. If you have a complaint about Findivo Technologies or our conduct, please contact us at legal@findivo.ie. We will endeavour to resolve all complaints within 14 business days. If you are not satisfied with our response, you may escalate your complaint to: (a) The Competition and Consumer Protection Commission (CCPC) at ccpc.ie; (b) The Data Protection Commission at dataprotection.ie (for data-related complaints); (c) The Irish Human Rights and Equality Commission at ihrec.ie (for equality-related complaints).

17. Third-Party Links & External Websites

17.1 The Platform may contain links to third-party websites, resources, or services. These links are provided for convenience only. We have no control over the content, privacy policies, or practices of any third-party website and accept no responsibility for them. 17.2 Accessing any external website linked from our Platform is entirely at your own risk. We strongly recommend that you review the terms and privacy policies of any third-party website you visit. 17.3 The inclusion of any link on our Platform does not imply our endorsement, approval, or association with the linked website or its operator.

18. User Feedback & Submissions

Any questions, comments, suggestions, ideas, feedback, or other information about the Platform provided by you to us ("Submissions") are non-confidential. By submitting any Submission, you grant Findivo Technologies a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, modify, publish, and distribute such Submissions for any purpose, without compensation or attribution to you. You waive any moral rights in such Submissions to the extent permitted by applicable law.

19. Governing Law & Dispute Resolution

19.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. 19.2 Jurisdiction. You irrevocably submit to the exclusive jurisdiction of the courts of Ireland for the resolution of any dispute arising out of or relating to these Terms or your use of the Platform. We retain the right to bring proceedings against you in the courts of your country of residence or any other court of competent jurisdiction. 19.3 EU Online Dispute Resolution. If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. 19.4 Informal Resolution. Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute informally by contacting us at legal@findivo.ie and allowing 30 days for good-faith resolution.

20. General Provisions

20.1 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Findivo Technologies regarding your use of the Platform. 20.2 Severability. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. 20.3 Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. All rights and remedies are cumulative. 20.4 Assignment. We may assign our rights and obligations under these Terms without your consent in connection with a merger, acquisition, or sale of assets. You may not assign your rights under these Terms without our prior written consent. 20.5 Amendments. We may update these Terms at any time. We will notify you of material changes by email or by a prominent notice on the Platform at least 14 days before the changes take effect.
